Many employers sponsor matching gift programs and will match charitable contributions made by their employees, and sometimes the employee's spouse. Gifts of Real and Personal Property


Can I donate any real estate and personal property to Jannet Hopewell Ministries?

Yes. There are two major forms of property: real and personal.

Real property is simply real estate -- a home, farm, or other land. Personal property includes cash, securities, and intangibles such as art, patents, copyrights, computer equipment, and other items that have a determinable value. According to the Internal Revenue Service, services do not have a determinable value and may not be deducted as a charitable contribution.


What type of real estate can be donated?

Many donors contribute real estate such as their residence, vacation home, farm, ranch, commercial property, or undeveloped land. Usually, JHM will accept gifts of real estate if there are no restrictions placed on selling the property.                    (We reserve the right to accept or refuse all property donations.) Real property can be donated as a current gift. Real property may also be part of the planned giving process. The donation is worth the property's fair market value, which must be established by an independent appraisal.


Can I give mortgaged property?

When mortgaged property is donated, it is subject to bargain sale rules. According to the IRS, a bargain sale occurs when property is sold to a charity at a price less than fair market value or when it is mortgaged or otherwise encumbered. In these circumstances, the donor has made a charitable gift and a sale. The sale element of such a transaction may have capital gains consequences. These transactions, because of their complexity, should be closely examined by the donor's tax advisor.


Is it true that I can donate my home to JHM and continue to live in it for the rest of my life?

Yes. This gift is most suitable for older donors who can expect to remain in the property until death. The arrangement is irrevocable and the donor is still responsible for all taxes and upkeep of the property. A tax deduction is allowed in the year the gift is arranged.


What are tangible property gifts?

Gifts of tangible personal property include gifts like furniture, art work, jewelry, books, coins, and stamp collections. Gifts of tangible personal property that (1) are legitimately appraised and (2) satisfy the "related use" standard will also qualify for a tax deduction.


What is deductible if I donate tangible property?

A gift of tangible personal property -- such as furniture, art works, jewelry, antiques, books, and coin and stamp collections -- is deductible for its full fair market value (up to 30% of your adjusted gross income) if it meets two conditions: 1) it must be documented by a legitimate appraisal and 2) it must satisfy the "related use" standard.

"Related use" means that JHM must be able to use the gift in a way that is related to or furthers its mission. Some examples: Books donated to the library will meet the standard, as will office furniture, computers, or business machines. A painting will meet the standard if it is displayed for viewing, but will not if JHM sells it.

Property that does not satisfy the "related use" standard may still be deducted, but only for your cost basis in the property, subject to a limit of 50% of your adjusted gross income. The five-year carry over rule for the deduction applies in both cases.


When are tangible property gifts considered complete?

A gift of tangible personal property is considered complete on the date when ownership or legal title is transferred. To make the formal transfer, you may write a simple "letter of intent to donate" that identifies the property and includes a signed statement of your intent to transfer it to Jannet Hopewell Ministries-USA.


How are property gifts classified?

Real property includes all gifts of real estate. In most instances, such a property will be sold; in other cases, it may be kept as an investment. Many of the tax advantages that apply to gifts of appreciated securities also apply to gifts of appreciated real property.

Tangible personal property includes works of art, furniture, equipment, collections, and personal mementos. For tax purposes, the date of the gift is the date of physical delivery, and the value is the item's fair market value on that date as determined by a competent appraiser.


How is the value of my property determined?

When you contribute property to a qualified organization, the amount of your charitable contribution is generally the fair market value of the property at the time of the contribution. Fair market value is defined by the IRS as the price at which property would change hands between a willing buyer and a willing seller, neither having to buy or sell, and both having reasonable knowledge of all relevant facts. There is no single formula that always applies; therefore, we suggest you review IRS Publication 561, which sets forth the manner in which the IRS requires you to determine the value of donated property.

How to remember JHM in your will

When making or revising a will, you should always obtain the assistance of an attorney. Members of our ministry's development office will be pleased to work with you and your attorney/solicitor to design an estate plan tailored to your wishes.

In addition to cash and securities, bequests to JHM may include real estate, works of art, or patent rights. All outright bequests to JHM are exempt from federal estate taxes, and there is no limitation on the size of the gift.

The following are suggested forms for making various types of bequests:


Outright bequest in a will or in a trust

Specific dollar amount:
"I bequeath the sum of $_____ to the JANNET HOPEWELL MINISTRIES, 5348 Vegas Drive, Las Vegas, Nevada, 89108 to be used or disposed of as its Board of Directors in its sole discretion deems appropriate."

Specific property (personal property):
"I bequeath <DESCRIPTION OF PROPERTY> to the JANNET HOPEWELL MINISTRIES, 5348 Vegas Drive, Las Vegas, Nevada, 89108 to be used or disposed of as its Board of Directors in its sole discretion deems appropriate."

Specific property (real estate):
"I devise all of my right, title, and interest in and to the real estate located at <DESCRIPTION OF PROPERTY> to the JANNET HOPEWELL MINISTRIES, 5348 Vegas Drive, Las Vegas, Nevada, 89108 to be used or disposed of as its Board of Directors in its sole discretion deems appropriate."

Percentage of your estate:
"I devise and bequeath (all/or _____%) of the remainder of my property to the JANNET HOPEWELL MINISTRIES, 5348 Vegas Drive, Las Vegas, Nevada, 89108 to be used or disposed of as its Board of Directors in its sole discretion deems appropriate."


Conditional bequest in a will

Insert conditional language in one or more of the above provisions.

For example:

"If my husband/wife does not survive me, I bequeath the sum of $_____to the JANNET HOPEWELL MINISTRIES, 5348 Vegas Drive, Las Vegas, Nevada, 89108 to be used or disposed of as its Board of Directors in its sole discretion deems appropriate."

If the gift to JANNET HOPEWELL MINISTRIES is for a purpose other than JHM's unrestricted use, insert the restriction in place of the words "to be used or disposed of as its Board of Directors in its sole discretion deems appropriate."

For example:

"I bequeath the sum of $_____ to the JANNET HOPEWELL MINISTRIES, 5348 Vegas Drive, Las Vegas, Nevada, 89108 for the following use and purpose: <DESCRIPTION OF PURPOSE>."

In the event a gift is subject to a restriction, we suggest including one of the following provisions:

"However, I impose no legal or equitable obligation in this regard." or "If in the judgment of the Board of Directors of the JHM, it becomes impossible to accomplish the purposes of this gift, the income or principal may be used for such related purposes and in such manner as determined by its Board of Directors."

What is a Charitable Trust?


Charitable Trusts are gift agreements that allow you to make a significant charitable gift while preserving economic security for yourself and others. Because Congress has sanctioned these gift agreements, tax savings are provided and often allow immediate and long-term tax benefits.

Charitable Remainder Trusts are some of the most popular trusts established by donors for the benefit of one or more charities. Some of the basic features and advantages are described below. The two basic remainder types are the Charitable Remainder Unitrust and the Charitable Remainder Annuity Trust.


How it works


You transfer cash and/or appreciated assets into an irrevocable trust expressly designed by and for you.

Each trust agreement requires that:

  • You designate a Trustee (e.g., yourself or a bank trust department).
  • You name income beneficiaries.
  • You determine the trust term (e.g., for the lifetime of the beneficiaries or for a term of years, not to exceed twenty years).
  • You select a payout percentage. A minimum 5% payout is required.
  • You select the frequency of payout payments -- annually, semi-annually, or quarterly.
  • You designate the charitable beneficiaries.
  • You are entitled to certain charitable deductions determined when the trust is established. This is the portion the designated charities will receive at the end of the trust term.
